MEMORANDUM

McGUIRE, District Judge.

This is an action brought under 35 U. S.C. § 145 in which the plaintiff as assignee of a patent application entitled “Corneal Contact Lens with Peripheral Clearance”, Serial No. 539,228, filed December 29, 1965, seeks Court adjudication authorizing the issuance of a patent on Claims 1 through 4 of its application. This application is a continuation of application Serial No. 333,531 filed December 26, 1963 which, in turn, is a continuation of application No. 701,153 filed December 6, 1957.
