Appeal from an order of the Supreme Court (O’Shea, J.), entered April 2, 2014 in Chemung County, which, among other things, accepted service of defendant’s answer.
Plaintiff commenced this breach of contract action against defendant, his disability insurance carrier, in January 2014 seeking damages in excess of $500,000. The parties thereafter entered into a written stipulation extending defendant’s time to answer until February 24, 2014.
