HAWKINS, Judge.
— Appellant is under conviction for the murder of Lillian Holland, his punishment having been assessed at confinement in the penitentiary for twenty years.
Appellant and deceased were both negroes. Lillian Holland and her husband were separated and she and appellant had for some time been living together in adulterous relations.- On the night preceding the killing, over appellant’s protest, she had remained away from home attending a party.
