Appeal from a judgment of the circuit' court for St. Croix county: E. W. Helms, Circuit Judge. Action of trespass, for that the city of Hudson, under its general power over its streets, by resolution of its common council proceeded to grade Third street according to the established grade, and directed the street commissioner and the city surveyor to liave such, grading done. They accordingly graded the street to the established grade to its frill width on top.
