MEMORANDUM ORDER

BUA, District Judge.

This order concerns both parties’ motions for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. For the reasons stated herein, defendant’s motion is granted and plaintiff’s motion is denied.

I. FACTS

Plaintiff Derek Johnson brings this action pursuant to 42 U.S.C. § 405(g) seeking review of a final decision of the defendant Secretary of Health and Human Services (Secretary) in which plaintiff was denied Social Security benefits. 1 Plaintiff was 34 years old at the time of the Secretary’s decision.
