The plaintiff, Richard Foster, brought an action in the Superior Court seeking the proceeds of two insurance policies owned by his former wife, Janice Hunter (decedent), which designated the decedent’s new husband, Michael J. Hurley, as beneficiary.2 Foster alleged that the policies’ proceeds should have been awarded to him under the terms of a separation agreement incorporated into his and the decedent’s final divorce decree.
