Appeal from judgment of the General Term of the Court of Common Pleas of the city and county of New York, entered upon an order made June 16, 1890, which affirmed a judgment in favor of defendants, entered upon a verdict of the District Court in the city of New York. The nature of the action and the facts, so far as material, are stated in the opinion.

This action was brought for the foreclosure of a mechanics’ lien.
The defendant Bauer was the owner of premises known as-No. 3467 Third avenue in the city of New York, and as-such entered into a contract with the defendant Peter Spoonheimer to erect and. complete a building thereon, for which he was. to pay in six installments. The fifth installment was to become due when the cellar was concreted and the sidewalk and exterior iron and stone work was completed.
