Roger Hall, hereinafter called plaintiff, recovered a judgment totaling $8,000 as damages against W. A. Brookshire, hereinafter called defendant, in an action for libel. Defendant filed a motion for new trial and also filed his separate after-trial motion for judgment in accordance with his motion for a directed verdict. RSMo 1949, V.A.M.S., Section 510.290. The latter motion was overruled, but the court sustained defendant’s motion for a new trial. From the order granting a new trial, the plaintiff appealed.
