MEMORANDUM OPINION
TILLEY, District Judge.
This case arises between Plaintiffs Haywood and Sylvia Clayton (“the Claytons”) and Defendant Ameriquest Mortgage Company 1 (“Ameriquest”) and is currently before the Court on the following motions:
