Appellant-defendant was found guilty of fraudulent conversion in a nonjury trial before Hon. James A. Reilly, Judge of the Fourteenth Judicial District, spe*440daily presiding in the Fifth Judidal District. Appellant’s motions for a new trial and in arrest of judgment having been refused and judgment of sentence imposed, this appeal followed.

The indictment charged the defendant with having received from Elmer Jonnett, the prosecutor, the sum of $8,350 to be held and used by said defendant for certain purposes in connection with the prosecutor’s application for a mortgage…
