Conner filed this suit in the county court of Lynn county, Tex., against Jot Smyth, the Oklahoma Cattle Loan Company, and G. W. Small and W. B. Slaton, administrators of the estate of S. H. Windham, deceased, alleging in his petition, in substance, that on or about May 1, 1924, he was engaged in selling cattle on commission, and at the special instance and reguest of said cattle company and Jot Smyth he effected a sale of 1,156 head of cattle belonging to the S.
