Judgment, Supreme Court, Bronx County (Peter Benitez, J.), rendered May 7, 2001, convicting defendant, after a jury trial, of murder in the second degree and rape in the first degree, and *118sentencing him, as a persistent felony offender, to concurrent terms of 25 years to life, unanimously affirmed.

The verdict was based on legally sufficient evidence and was not against the weight of the evidence. There is no basis for disturbing the juiy’s determinations concerning credibility. The element of forcible compulsion required to prove rape, and concomitantly to prove felony murder, was established…
