At Civil Action No. 23,586, Driver, Guardian of the Estate of Donald C. Homel, a minor, brought suit against Gindy Manufacturing Corporation, Singer Transportation Company, and Irene J. Turner, jurisdiction being based upon diversity. Burroughs was made a third-party defendant. At Civil Action No. 26,077, Homel himself, after he became sui juris, sued Burroughs, jurisdiction also being based on diversity.
