This case is brought before us by a writ of error to a judgment of the. Circuit Court of Nansemond county on the petition of the Atlantic Coast Line Railroad Company, plaintiff in error.
S. F. Warrington, defendant in error (plaintiff below), brought an action of assumpsit against the above company, *333claiming damages in the sum of $1,200 on account of loss suffered on certain shipments of Irish potatoes due to the-alleged unreasonable delay in the transportation of the same by the said company.
