This is an appeal from a decision of the Appellate Court of Illinois, First District, reversing a decree of the superior court of Cook County modifying a child custody award, and remanding the cause.

Defendant, Herbert Nye, appellant here, and plaintiffappellee, formerly Constance Nye and now Mrs. Herbert Bruckner, were married on April 10, 1938. One child, a daughter, Diane, known as Penny, was born to the parties on October 1, 1942.
