In March 2008, pursuant to a citizen-filed petition under K.S.A. 22-3001(2), the district court of Wyandotte County impaneled a grand juiy to investigate allegations of criminal activity by the Board of Public Utilities (BPU) of the Unified Government of Wyandotte County/Kansas City, Kansas. After 6 months of hearings, the grand jury returned an indictment against Rodney Turner for 2 counts of theft and 55 counts of presenting a false claim. Turner filed a motion to dismiss the indictment for abuse of the grand jury, and the district court granted the motion. The State appeals the…
