This is an appeal from the judgment of the county court of Tulsa county. The cause was tried to a jury on the 24th day of October, 1928-, and on the same day verdict was returned against the plaintiff in 'error, and on the 25th day of October the motion for new trial was overruled and judgment entered in said cause, from which judgment the plaintiff in error appeals. At the time of the overruling of the motion for new trial the plaintiff in error was allowed 80 days in which to prepare and serve his case-made.
