Defendant-appellant, Mark F. Dougherty (“appellant”), appeals from the judgment entry of conviction and sentencing in the Hancock County Court of Common Pleas.

The trial transcript reveals the following facts. In the early morning hours of July 17, 1992, appellant, his brother, John Dougherty, and John’s wife, Brenda, traveled to Findlay, Ohio.
