In their brief, appellants set forth a statement of the case as follows:

The appellee Gerald Fitz-Gerald, brought this suit for construction and interpretation of the Will of Jessie Wallace, who died October 12, 1964, asserting there were “difficult and doubtful questions” respecting the provisions of the purported will, and asserting that the meaning and effect of the provisions were “not clearly understood”.
