TIREY, Justice.

J. D. Mires brought this suit against Falls County for a balance claimed to be due him on his salary. The case was submitted to the court (non-jury) on an agreed statement of facts. The court entered judgment in behalf of plaintiff for $4000, as principal, *493and $340, as interest and both parties have appealed from this decree.
