Appeal by the defendant from a judgment of the Supreme Court, Suffolk County (Mullen, J., at trial; Rohl, J., at sentence), rendered August 22, 1988, convicting him of operating a motor vehicle while intoxicated (two counts), operating an uninspected motor vehicle, and speeding, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed, and the matter is remitted to the Supreme Court, Suffolk County, for further proceedings pursuant to CPL 460.50 (5).
