This is a law action, pending in the Circuit Court of Kanawha County, in which Wilburn Hayes is plaintiff, and The Town of Cedar Grove, a municipal corporation, created and organized under the laws of the State of West Virginia, is defendant, in which plaintiff seeks to recover damages for personal injuries sustained by him while in the employ of the defendant, and alleged to have resulted from the negligence of his fellow-employees, and failure to provide and to keep in good repair proper equipment for the work being performed.
