PREGERSON, Circuit Judge:

Defendant-Appellant Employers Health Insurance appeals the district court’s order remanding for a second time to the Arizona Superior Court Plaintiff-Appellee The Meadows’ state law action. The Meadows sued Employers Health Insurance for negligent misrepresentation, estoppel, and breach of contract arising out of an inquiry concerning coverage. The district court held that in the circumstances of this case, the Employee Retirement Income Security Act of 1974, 29 U.S.C. §§ 1001 et seq. (“ERISA”) did not preempt these state law causes of action. We have jurisdiction…
