INTRODUCTION

In this civil action the plaintiff Jeffrey B. Brooks (Brooks) seeks judicial review of a decision by the Civil Service Commission (Commission) which dismissed his complaint against the defendant Department of Correction (department)1 in which he maintained that he was entitled to the procedural safeguards set forth in G.L.c. 31, §41 before he was placed on a ten-month period of unpaid leave.
