BRENNAN, Chief Judge.

Defendant moves to dismiss Count I of the Indictment herein upon the ground that same was not found within six years after the alleged offense was committed.

On February 28, 1952, an indictment against the defendant was filed in this court which in substance charg-es him with a violation of Section 145(b), Title 26 U.S. C.A. Count I, which alone is involved here, charges that the defendant on January 29, 1946, and within six years from the date of the indictment, excluding the time during which the defendant was absent from the' Northern District of New York, did attempt…
