This is an action in assumpsit brought by a real estate broker to recover the balance, alleged to be due, of a commission for the sale of real estate. The trial in the Superior Court resulted in a verdict for the plaintiff for $221 and the case is before us on the defendant’s exception to the admission of evidence and on an exception to the refusal of the trial court to grant a new trial.
