OPINION
THOMAS, Justice.
William R. Waugh appeals a summary judgment granted in favor of the City of Dallas arising out of his suit for declaratory judgment to set aside a municipal zoning ordinance. In two points of error, Waugh argues that the trial court erred in granting the City’s motion for summary judgment and in denying his motion for summary judgment. We hold that the trial court erred in granting the City’s motion for summary judgment as it related to Waugh’s constitutional claim relative to allegations of “gerrymandering.” Thus, the first point of error as it relates to the…
