MEMORANDUM OPINION AND ORDER
CASTILLO, District Judge.
Peachtree Lane Associates, Ltd. (“Peach-tree” or “debtor”), a chapter 11 debtor-in-possession, filed an adversary action (subsequently amended) against Harry, Alan, and Daniel Granader (collectively “defendants”) seeking a declaratory judgment determining the parties’ rights under a grant of easement and seeking injunctive relief against the defendants, inter alia, enjoining them from encroaching upon the debtor’s property.
