Barker sued out this writ of error to a judgment of conviction entered in the district court upon the verdict of a jury finding him guilty of the crime of forgery. The information in pertinent part charged Barker with falsely uttering and passing at one of the Safeway Stores in Jefferson County as true and genuine a check written on the account of Angelo T. De Carolis at the Jefferson County Bank, “knowing the same to be a false, altered, forged and counterfeited instrument” and with the intent to defraud the Safeway…
