Recently, in Dorsey v. Consolidated Freightways, a near-unanimous court granted relief to the plaintiffs on the basis that the defendant's filing of a motion to dismiss three of the five plaintiffs from the suit constituted a step in the defense of the action sufficient to interrupt abandonment as to the remaining plaintiffs. 00-0772 (La.5/26/00), 762 So.2d 628.[1] We are confronted today with a case similar to Dorsey, albeit not identical in that Dorsey…
