The object of the present action is to recover the purchase money stipulated to be paid by a written contract, by which the plaintiff agreed to convey jointly with his wife in fee simple, and the defendant agreed to purchase, an undivided interest in a house and land in Winter Street in Boston, belonging to the plaintiff’s wife. The defendant admits that the plaintiff has tendered to him deeds of such undivided portion, according to the contract, and sufficient in form to convey the same in fee simple.
