I. INTRODUCTION

A. PROCEDURAL HISTORY

This is an action for injunctive relief and declaratory judgment arising out of new regulations promulgated on April 29,1994 by the Secretary for the Department of Education. 59 Fed.Reg. 22335 (1994) (to be codified at § 600). The regulations define a “proprietary institution of higher education” for purposes of receipt of Title IV, Higher Education Act (“HEA”) funds. The new regulations became effective on July 1, 1994.
