The action was for conversion. In December, 1909, plaintiff was employed by one *288Wolff, vice-president of defendant, to serve as a clothing salesman at one of the defendant’s shops in this .city. He' was to be paid by salary' and commission. One Ryder was manager of the department in which plaintiff worked, and appears to have had general charge of the salesmen.
