This is an action by the receiver of the American Bank & Trust Company against the defendants Homeseelcers’ Realty Company, J. W. Young, E. K. De Loach, and John Hughes Cooper, commenced in November, 1926, in the Court of Common Pleas for Richland County. The defendant, E. K. De Loach, on whom service was obtained November 29, 1926, demurred to the complaint, and on a hearing of the demurrer before his Honor, W. H.
