SUMMARY ORDER

Defendant-appellant Russell Brooks appeals a memorandum decision and order entered by the United States District Court for the Northern District of New York (Hurd, J.). The order granted in part and denied in part the defendants’ motion to dismiss the complaint. In its partial denial of the motion, the district court rejected Brooks’s claim that he was entitled to qualified immunity. Brooks appeals that portion of the district court’s decision. We assume the parties’ familiarity with the underlying facts, procedural history, and issues on appeal.
