Appellees, Charles B. Ketcham and others, filed a bill in chancery in the circuit court of Fulton county for partition of a tract of land of about nine acres situated in that county. They are heirs-at-law or claim under the heirs-at-law of Emma Ketcham, deceased. From the pleadings and proofs it appears that on May 15, 1902, the said Emma Ketcham died seized of the real estate in controversy, leaving her surviving.the appellant, Lewis Y.
