MORROW, Judge.
Appellant, under indictment for murder, was convicted of manslaughter.
He was an .employe of the State penitentiary, guarding convicts, and shot and killed Gaston Pope, a convict. The controverted issue was under what circumstances the homicide took place. The State’s theory tended to show an unprovoked murder; that of appellant pointed to justification upon the ground of self-defense.
