Judgment, Supreme Court, Bronx County (Irene Duffy, J.), rendered July 16, 1990, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him to a term of IVz to 4 Vi years imprisonment, unanimously affirmed.
Defendant was arrested for selling narcotics to an undercover police officer. At the pre-trial hearing, the court ruled that it would allow testimony relative to three uncharged drug sales to demonstrate that the defendant had acted in concert with his accomplice.
