The appellee brought this action against the appellant, alleging in the first paragraph of his complaint, that on the 18th day of March, 1876, he 'brought an action in the Greene Circuit Court against the appellant by the name of the St. Louis, Bloomfield and Louisville Railroad Company, a name by which the appellant was well known; that *84a summons was issued and served upon the president 0f the ■appellant who employed counsel to defend the action, and who caused an appearance to be entered and an answer to be filed; that afterward the appellant withdrew its appearance,’ was defaulted,…
