OPINION

LEWIS, Judge.

¶ 1 Appellant, Richard Eugene ossip, was charged with the First Degree (malice) Murder in violation of 21 O.S.Supp.1996, § 701.7(A), on January 14, 1997, in Oklahoma County District Court Case No. CF-97-244.
