This appeal is from the decree of the court of quarter sessions setting aside a report of viewers appointed to assess damages caused by the vacation of Upsal street and by the confirmation of a plan of resurvey.
*152From the record it appears that pursuant to an ordinance of April 17, 1856, the board of surveys of the city of Philadelphia made a resurvey of the plan of the old borough of Germantown, which resurvey placed Upsal street on the city plan; this was confirmed by the proper authority, on March 29, 1866.
