The action is in ejectment. The land, the title to which is in dispute, is the right of way on which is constructed a railroad operated by the receiver of the Boston and Maine Bailroad, beginning . at the line of the Bensselaer and Saratoga Bailroad (leased to the Delaware and Hudson Company) in Mechanieville and extending to the northerly switch at the Saratoga junction, which is the point where the Boston and Maine line to Boston curves across the Hudson river bridge immediately north of Mechanieville.
