KALBFLEISCH, District Judge.

This is a petition of Quellon-King Company to review a decision by Referee Carl D. Friebolin denying a motion to re-open this case and vacate an entry of dismissal.

The findings of fact made by the Referee, as to which there is no dispute, reflect that Willie Decius Brooks filed his petition and was adjudicated bankrupt on September 28, 1960. A trustee was appointed, who filed a report of “No Assets” on November 15, 1960.
