In a proceeding pursuant to CPLR article 75 to permanently stay arbitration of an uninsured motorist claim, Greater New York Insurance Company appeals from an order of the Supreme Court, Nassau County (Trainor, J.), dated June 5, 1995, which, after a hearing, granted the petition.

*475Ordered that the order is reversed, on the facts, without costs or disbursements, and the matter is remitted to the Supreme Court, Nassau County, for a de novo hearing and determination in accordance herewith.
