The plaintiff, who had previously been- employed as a laborer on an hourly basis by the defendant company, which was engaged in the construction of an addition to a hospital in Worcester, came to the hospital premises on various occasions seeking employment. On his last visit before the accident he was told by the defendant’s superintendent that there was no work then but that if he returned the first of the following week the superintendent would put him to work if there was any available work.
