WALKER, Circuit Judge.

This suit was begun by the appellee, on December 7, 1928, suing out an attachment in the superior court of Fulton County, Georgia. Prior to December 18, 1928, it was removed to the court below by the party whose property was ordered to be attached, one of the appellants, S. A. Lynch Enterprise Finance Corporation, herein referred to as the appellant; a certified copy of the record being filed in the court below on that date. The attachment affidavit alleged that the appellant was indebted to appellee “in the sum of $38,000.00 principal and approximately $7,500.00…
