Appeal by the relator, Citizens’ Lighting Company, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 13th day of March, 1902, dismissing the writ of certiorari theretofore issued in this action to review an assessment of relator’s personal property.

Hatch, J.:

The question involved in this appeal is-one of procedure. The relator was assessed by the commissioners of taxes and assessments of the city of New York the sum of $25,000 upon its property. Thereupon it made an application in due form for the review of this assessment, contending before the commissioners of taxes and assessments that it was exempt from all assessments whatever.
