This suit was brought by appel-lee, as plaintiff below, against appellant, as *1181defendant, March 4, 1908, to enforce specific performance of the following contract, executed by them on the 10th of September, 1907, to wit:
“The State of Texas, County of Washington —This memorandum of an agreement this day made and entered into by and between Job Thigpen, of the county of Fayette and state of Texas, party of the first part, and Ed Roos of the county of Bexar, and state of Texas, party of the second part, witnesseth:
“(1) That first party, for and in consideration of the sum of one thousand ($1,000)…
