Defendant, Ernest Garland Allen, was indicted on 6 March 1995 for the first-degree murder of Kathy Allen, attempted first-degree murder of Gerald Ross Freeman, assault with a deadly weapon with the intent to kill inflicting serious injury against Gerald Ross Freeman, and discharging a firearm into occupied property. Defendant was tried capitally at the 2 October 1995 session of Superior Court, Buncombe County, and was found guilty of first-degree murder under the felony murder rule, attempted first-degree murder, assault with a deadly weapon with intent to kill, and…
