Before the court are cross motions for summary judgment (the “SMUD Motion”, the “MAEM Motion”, and collectively the “Motions”) filed by Mirant Americas Energy Marketing, L.P. (“MAEM”) and Sacramento Municipal Utility District (“SMUD”) in the above-styled adversary proceeding (the “Adversary”).
